STAKEHOLDERS IN THE ACQUISITION PROCESS OF A LAND

In the acquisition procedure, there are two categories of stakeholders: direct stakeholders who are visible and indirect stakeholders who are not. They are structured chronologically:

1. The seller (direct intervener)

He is the owner of the plot of land or his agent. He signs the request for fragmentation or total transfer as well as the demarcation reports.

2. The buyer (direct stakeholder)

He signs the demarcation reports. If he has a proxy, the latter can do so.

3. The surveyor (direct speaker)

It is the professional who performs the topographic survey and implements the landmarks.

4. The cadaster (indirect stakeholder)

It is an administrative service which establishes following the topographic documents introduced by the surveyor the technical file. He ensures the authenticity of the land title, the validity of the subdivision plan and the multiple non-sale of a plot of land, etc.

5. The town hall or the urban community (direct intervener)

Among its missions, it establishes the certificate of Town planning. Its validity is six months.

6. The Notary (direct speaker)

Public officer, he receives or writes the acts of real estate, contracts (marriage contract, donation, etc.). In the acquisition of a plot, He authenticates the deed of sale by affixing his seal and his signature, makes it register with the tax administration and transmits it to the land registrar of his locality for the establishment of the land title.

7. The tax administration (indirect stakeholder)

The tax administration is a service attached to the Ministry of Finance whose main mission is the collection of different forms of taxes. In this procedure, it collects the registration fees for the deed of sale, property taxes and other taxes attached to it, all of which are introduced by the notary.

8. The land registrar (indirect stakeholder)

The land registrar is the guarantor of the land heritage in his locality. Through the certificate of ownership, He establishes the reality of the land heritage. Based on the deed of sale and other documents introduced by the notary; it establishes the land title.

9. The Town Hall or the urban community (direct intervener)

It establishes the building permit. The building permit is an official document which authorizes you to construct or renovate a building for residential, industrial, etc. use.
